2007 Legislative Changes to Commercial, Consumer, Debtor-Creditor, and Lien Law

The 2007 Legislature enacted a number of laws that will affect the practice of debtor-creditor and consumer law in Oregon. By far the largest number of bills that affect practice in these areas are in the consumer protection field. Significant changes were also made in procedure and execution. Legislative Committee

The section’s legislative committee has proposed four bills (SB 301 re nonjudicial trust deed foreclosure service requirements, SB 302 re secured creditors remedies after debtor’s death, SB 303 re wage garnishment, and SB 304 re correcting a dropped cross-reference in UCC Revised Article 9) and is monitoring other bills to determine whether the section should take positions on them. Any section member who would like to join the committee or wishes to suggest that the section take a position on a bill should contact committee chair David W. Although it’s now (February 13, 2007) probably too late in the current session to introduce entirely new bills, please feel free to send the committee chair any ideas or concerns you believe the committee should address for legislation in future sessions.
